Terms of Service
Please read these terms carefully before using MatchOnWay.
1. Acceptance of Terms
By accessing or using MatchOnWay's website, mobile applications, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services. We reserve the right to update these Terms at any time. Continued use of the Services after changes are posted constitutes your acceptance of the revised Terms. We recommend reviewing these Terms periodically.
2. User Account & Registration
To access certain features, you must create an account. You agree to: - Provide accurate, current, and complete information - Maintain the security of your password - Promptly update any information that becomes inaccurate - Accept responsibility for all activity under your account You must be at least 18 years old to create an account. We reserve the right to suspend or terminate accounts that violate these Terms. Each person may maintain only one account.
3. User Conduct & Responsibilities
When using our Services, you agree NOT to: - Violate any applicable laws or regulations - Post false, misleading, or fraudulent content - Harass, threaten, or intimidate other users - Upload malware, viruses, or harmful code - Scrape, mine, or systematically collect data from our platform - Impersonate any person or entity - Circumvent any security measures - Use the platform for commercial solicitation without prior consent Violation of these rules may result in immediate account termination.
4. Booking & Payment Terms
Tour Bookings: When you book a tour through MatchOnWay, you enter into a direct agreement with the tour operator. MatchOnWay acts as a marketplace and is not a party to the tour service contract. Payment Processing: All payments are processed securely through our payment partners. Prices are displayed in the selected currency and include applicable taxes unless stated otherwise. Booking Confirmation: A booking is confirmed only when you receive a written confirmation email from MatchOnWay. Availability is not guaranteed until confirmation is received. Pricing: Tour operators set their own prices. MatchOnWay reserves the right to display prices in multiple currencies. Exchange rates may fluctuate.
5. Cancellation & Refund Policy
Cancellation Terms: Each tour has its own cancellation policy set by the tour operator, clearly displayed at the time of booking. Standard Policy (where no specific policy applies): - 30+ days before tour: Full refund - 14-29 days before tour: 75% refund - 7-13 days before tour: 50% refund - Less than 7 days: No refund Operator Cancellations: If a tour operator cancels a tour, you are entitled to a full refund or rebooking at your choice. No-Shows: Failure to appear at the designated time and location without prior cancellation forfeits the booking fee. Refund Processing: Approved refunds are processed within 5-10 business days to the original payment method.
6. Intellectual Property
MatchOnWay owns all intellectual property rights in our platform, including but not limited to our logo, website design, software, algorithms, and written content. You may not reproduce, modify, distribute, or create derivative works from our content without express written permission. User-submitted content (reviews, photos, etc.) remains your property, but by submitting content you grant MatchOnWay a non-exclusive, royalty-free license to use, display, and distribute that content on our platform.
7. User-Generated Content
By posting reviews, photos, or other content on MatchOnWay, you represent that: - You own or have the right to post the content - The content does not infringe on third-party rights - The content is accurate and not misleading - The content does not violate our community guidelines MatchOnWay reserves the right to remove any user-generated content that violates these Terms or our community guidelines, without prior notice.
8. Tour Operator Liability
MatchOnWay is a marketplace that connects travelers with independent tour operators. We do not own or operate any tours. Tour operators are solely responsible for the accuracy of their tour descriptions, pricing, and availability, as well as the safety and quality of their tours, compliance with local laws and regulations, and proper insurance coverage. MatchOnWay performs basic verification of tour operators but does not guarantee the quality, safety, or accuracy of any tour listing.
9. Disclaimers & Limitations
OUR SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. To the maximum extent permitted by law, MatchOnWay shall not be liable for: - Indirect, incidental, special, or consequential damages - Loss of profits, revenue, data, or business opportunities - Personal injury or property damage arising from tours - Technical errors, downtime, or service interruptions - Actions of third-party tour operators In no event shall our total liability exceed the amount you paid for the specific booking giving rise to the claim.
10. Termination
MatchOnWay may suspend or terminate your account at any time for: - Violation of these Terms - Fraudulent or illegal activity - Providing false information - Engaging in abusive behavior You may delete your account at any time through your account settings. Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive termination will remain in effect.
11. Dispute Resolution
Informal Resolution: We encourage you to contact us first at [email protected]. We will attempt to resolve disputes within 30 days. Mediation: If informal resolution fails, disputes shall be submitted to mediation before arbitration. Arbitration: Disputes not resolved through mediation will be settled by binding arbitration under the rules of the Istanbul Arbitration Centre (ISTAC), with proceedings conducted in Turkish or English. Class Action Waiver: You waive the right to participate in class action lawsuits or class-wide arbitration.
12. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated by: - Email notification to registered users - Prominent notice on our website - Updated "Last Modified" date Your continued use of the Services 30 days after notice of changes constitutes acceptance of the new Terms.
13. Governing Law
These Terms are governed by the laws of the Republic of Turkey, without regard to its conflict of law provisions. For users in the European Union, mandatory consumer protection laws of your country of residence also apply. Any legal action not subject to arbitration shall be brought exclusively in the courts of Istanbul, Turkey.
